Terms of Service

TL;DR: Be respectful, don't abuse the service, and we'll do our best to help you eat better. CalPal is a tool, not medical advice.

1. Acceptance of Terms

By accessing or using CalPal (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you don't agree, please don't use CalPal.

These Terms apply to all users, whether you're on the free plan or a paid subscriber.

2. What CalPal Is (And Isn't)

✅ CalPal IS:

  • A conversational nutrition tracking tool
  • A way to log meals and understand your eating habits
  • A source of general nutritional information
  • A tool to help you reach your personal goals

❌ CalPal IS NOT:

  • Medical advice: CalPal is not a doctor, nutritionist, or healthcare provider
  • A diagnosis tool: We don't diagnose conditions or prescribe treatments
  • A replacement for professional care: Always consult your doctor for medical advice
  • Perfect: Nutritional estimates are approximate and may contain errors

Important: If you have a medical condition, eating disorder, food allergies, or are pregnant/nursing, consult a healthcare professional before making dietary changes.

3. Your Account

Account Responsibilities

  • You must provide accurate information when creating your account
  • You're responsible for keeping your account secure
  • You must be at least 13 years old to use CalPal
  • One account per person (no sharing accounts)
  • Notify us immediately if you suspect unauthorized access

Account Termination

You can delete your account anytime from Settings. We may suspend or terminate accounts that violate these Terms, including:

  • Abusive or harassing behavior
  • Attempting to hack or compromise the Service
  • Creating multiple accounts to abuse free trials
  • Violating others' privacy or rights

4. Subscriptions & Payments

Free Plan

CalPal offers a free plan with 50 messages per month. We may modify free plan features at any time.

Pro Plan ($4.99/month)

  • Billing: Subscriptions are billed monthly and auto-renew
  • Cancellation: Cancel anytime from Settings (no refunds for partial months)
  • Price Changes: We'll notify you 30 days before price increases
  • Payment Issues: If payment fails, your subscription may be suspended

Refund Policy

Subscriptions are non-refundable, but we're reasonable humans. If you have an issue within the first 7 days, email us at support@calpal.me and we'll work it out.

5. Acceptable Use

You agree NOT to:

  • 🚫 Use CalPal for any illegal purpose
  • 🚫 Attempt to reverse engineer or hack the Service
  • 🚫 Scrape, crawl, or collect user data without permission
  • 🚫 Upload malicious code, viruses, or spam
  • 🚫 Impersonate others or create fake accounts
  • 🚫 Abuse our support team or other users
  • 🚫 Use automated tools to create accounts or spam the Service

6. Your Content & Data

What You Own

You own your meal data, photos, and conversations. By using CalPal, you grant us permission to:

  • Store and process your data to provide the Service
  • Use anonymized, aggregated data to improve CalPal
  • Train and improve our AI models (your personal data is never shared publicly)

What We Own

CalPal's technology, design, branding, and AI models are our intellectual property. You can't copy, modify, or redistribute them without permission.

7. Service Availability

We strive for 99.9% uptime, but CalPal is provided “as is.” We don't guarantee:

  • Uninterrupted access (maintenance happens)
  • Error-free operation (bugs exist, we fix them fast)
  • 100% accurate nutritional data (estimates may vary)
  • Specific features will always be available (we evolve)

8. Limitation of Liability

To the maximum extent permitted by law:

  • CalPal is not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the past 12 months (or $100, whichever is greater)
  • We're not responsible for third-party services (e.g., OpenAI, payment processors)
  • Nutritional data is approximate—we're not liable for estimation errors

Translation: CalPal is a tool to help you make informed choices. It's not medical advice, and we can't be held responsible for health outcomes.

9. Dispute Resolution

Talk to Us First

If you have an issue, please contact us at support@calpal.me before taking legal action. We'll work with you in good faith to resolve it.

Arbitration

If we can't resolve a dispute informally, you agree to binding arbitration (not court) under the rules of the American Arbitration Association. Arbitration is faster and cheaper than litigation.

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action lawsuit.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the “Last updated” date and notify you via email or in-app notification. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict of law principles.
